These Terms of Service ("Terms") govern your use of www.umibites.com (the "Site") operated by Umibites ("we," "us," or "our"). By using the Site or joining a first-batch list, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old to use the Site or join a first-batch list. By using the Site, you represent that you are 18 or older.
2. First-batch lists are not a purchase
Joining a first-batch list is a request only. No payment is collected at that time and no order is created. Submitting a request does not guarantee that any product will become available, or that inventory will be reserved for you. If and when checkout opens, we will contact you so you can review the final price, shipping, availability, and timing before deciding whether to buy. Any purchase you later make will be subject to the terms presented at checkout.
3. Pricing and availability
Prices shown on the Site are estimates and may change. Products are offered in limited quantities and may sell out or become unavailable. We may correct errors, and may change or discontinue products, pricing, or the Site at any time without notice.
4. Product information and affiliation
Umibites is an independent importer/reseller and is not affiliated with, endorsed by, or sponsored by Kinokuniya or any brand shown, unless otherwise stated. Product names, packaging, and images are used for identification and reference only and remain the property of their respective owners. Imported products may have labeling, ingredients, or allergen information that differs from domestic equivalents; you are responsible for reviewing product details before consuming.
5. Acceptable use
- Provide accurate information when contacting us or joining a list.
- Do not use the Site for unlawful purposes or to interfere with its operation or security.
- Do not attempt to gain unauthorized access to the Site or its systems.
6. Intellectual property
The Umibites name, the "Umi" mascot, logo, and Site content are owned by us or our licensors and may not be copied or used without permission, except for third-party marks identified in Section 4.
7. Disclaimers
The Site and all information on it are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure.
8. Limitation of liability
To the fullest extent permitted by law, Umibites will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or participation in a first-batch list. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Privacy
Your use of the Site is also governed by our Privacy Policy.
10. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in California, and you consent to their jurisdiction and venue.
11. Changes to these Terms
We may update these Terms from time to time. Changes take effect when we post the updated version with a new effective date. Your continued use of the Site means you accept the updated Terms.
